Assumption of Risk & Liability Waiver
Spearfishing and freediving are inherently dangerous activities. By loaning equipment from Equipment Library, you acknowledge and accept the following.
Assumption of risk
You understand that spearfishing, breath-hold diving, and related activities involve serious risks including drowning, shallow water blackout, marine life injury, entanglement, boat traffic, and equipment failure. You voluntarily assume all such risks.
Fitness and competence
- You confirm you are physically fit and competent to use the loaned equipment.
- You will not use equipment beyond your training or experience level.
- You will dive with a buddy where appropriate and comply with local regulations, including Victorian fisheries and marine park rules.
- For overseas use, you accept responsibility for local laws, customs, and safety practices.
Release of liability
To the fullest extent permitted by law, you release Equipment Library, its operators, volunteers, and affiliated organisations from any claim, loss, or damage arising from your use of loaned equipment, including personal injury, property damage, or death, whether caused by negligence or otherwise except where liability cannot be excluded by law (including under the Australian Consumer Law).
Equipment use
You agree to use equipment only for its intended purpose, not modify it, and return it in the same condition subject to normal wear. You are responsible for equipment from checkout until accepted check-in by the administrator.
This waiver must be reviewed by a qualified solicitor. Certain consumer guarantees under Australian law cannot be excluded.
